1. Scope of Agreement
By engaging Eric Ross Investments LLC ("Agency", "we") for digital marketing services, you ("Client") agree to these Terms of Service. All services will be detailed in a formal Statement of Work (SOW) which forms part of this agreement.
2. Digital Marketing Service Conditions
The Agency will perform the services outlined in the SOW with professional skill and care. The Client understands that digital marketing is a dynamic field and that specific outcomes (e.g., #1 search ranking) cannot be guaranteed. Our focus is on implementing proven strategies to work towards the agreed-upon objectives.
3. Timelines
All project timelines provided in the SOW are good-faith estimates. The Agency is not liable for delays caused by the Client (e.g., delayed feedback, asset delivery) or by third-party platforms (e.g., search engine algorithm updates).
4. Payment Terms
Fees for services will be detailed in the SOW. Payments for recurring retainer services are due in advance of the service period. All payments made to the Agency for services rendered are non-refundable. Failure to make timely payments may result in a temporary suspension of services.
5. Legal Disclaimers & Limitation of Liability
The services are provided "as is". In no event shall Eric Ross Investments LLC be liable for any lost profits, or indirect, consequential, or special damages. The total liability of the Agency for any claim shall not exceed the fees paid by the Client to the Agency in the three (3) months prior to the claim.
